Terms of Service

These Terms of Service ("Terms") are a binding agreement between Kembo (ByteStronauts) ("Kembo", "we", "us") and the person or entity that registers for or uses the Kembo platform ("Customer", "you"). By creating an account, using the dashboard, APIs, or SDKs, you agree to these Terms and to our Data Processing Agreement ("DPA"), which is incorporated by reference.

1. The service

Kembo provides authentication infrastructure for mobile and web applications, including dashboard tools, APIs, and SDKs. Optional project analytics is available on paid plans and is designed to collect pseudonymous usage statistics only. The app module may store a random identifier per install (not linked to Kembo login); Kembo stores only a daily hash for visitor counts and does not store IP addresses for analytics. Features may change over time as we improve the product.

2. Accounts and security

  • You must provide accurate registration information.
  • You are responsible for all activity under your account, projects, and API keys (including publishable and secret keys).
  • You must keep credentials confidential, rotate compromised keys promptly, and notify us of unauthorized use.
  • You must be at least 18 years old (or the age of majority in your jurisdiction) and have authority to bind your organization.

3. Acceptable use

You agree not to:

  • use Kembo for unlawful, harmful, fraudulent, or deceptive purposes;
  • process special categories of personal data, children's data without appropriate safeguards, or any data you lack a lawful basis to process;
  • send personal identifiers, credentials, or unnecessary PII in analytics events or custom properties;
  • attempt to disrupt, probe, scrape, or bypass security controls;
  • reverse engineer the service except where permitted by mandatory law;
  • resell, white-label, or sublicense the service without our written consent;
  • use Kembo in a manner that violates third-party rights or applicable law (including GDPR, ePrivacy, and app store policies).

4. Your data and end users

You retain ownership of data you submit to Kembo. You grant us a limited license to host, process, transmit, and display that data solely to provide the Services. For Personal Data about your application's end users, you are the data controller and Kembo is your data processor as described in the DPA and Privacy Policy.

You represent and warrant that:

  • you have a lawful basis to use Kembo for authentication and any analytics features you enable;
  • your privacy notices accurately describe Kembo-powered sign-in and, if applicable, Kembo Analytics (including the dashboard privacy snippet);
  • you will not enable analytics or configure events in a way that instructs us to process data you are not permitted to share.

5. Subscriptions and billing

Paid plans are billed according to pricing shown at checkout. Subscriptions renew automatically until cancelled. Fees are non-refundable except where required by mandatory consumer law. You are responsible for applicable taxes.

6. Service availability and support

We strive for high availability but do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, and force majeure may affect the Services. Support is provided on a reasonable efforts basis via email.

7. Intellectual property

Kembo and its documentation, software, branding, and website content are owned by ByteStronauts or its licensors. You receive a limited, non-exclusive, non-transferable right to use the Services during your subscription. You retain ownership of your applications and content.

8. Confidentiality

Each party may receive confidential information from the other. The receiving party will use it only to perform under these Terms and will protect it with reasonable care. This does not apply to information that is public, independently developed, or lawfully obtained from a third party without restriction.

9. Indemnification

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless ByteStronauts, its affiliates, and their officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • your applications, products, or services;
  • your breach of these Terms, the DPA, or applicable law;
  • your processing instructions, configurations, or data you submit (including analytics events and custom properties);
  • your failure to provide adequate privacy notices or a lawful basis for processing end-user data;
  • allegations that your content or use of Kembo infringes third-party rights.

We will promptly notify you of claims subject to indemnification and cooperate at your expense. We may participate in the defense with counsel of our choice at our expense. You may not settle any claim in a manner that admits fault or imposes obligations on us without our prior written consent.

10. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.
  • EXCEPT FOR EXCLUDED CLAIMS BELOW, EACH PARTY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS, THE DPA, OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO KEMBO FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) EUR 10.

Excluded claims: The limitations above do not apply to (i) your indemnification obligations, (ii) your payment obligations, (iii) either party's fraud or willful misconduct, or (iv) liability that cannot be limited under mandatory applicable law (including certain data protection liabilities where non-excludable).

12. Termination

You may stop using Kembo at any time. We may suspend or terminate access immediately if you violate these Terms, pose a security or legal risk, or fail to pay amounts due. Upon termination, your right to use the Services ends. Sections that by nature should survive (including indemnification, limitations of liability, governing law, and payment obligations) will survive.

13. Changes

We may update these Terms or the DPA by posting a revised version and updating the "Last updated" date. Material changes will be notified via the dashboard or email where practicable. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Services.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Slovenia, without regard to conflict-of-law principles. The courts of the courts of Ljubljana, Slovenia have exclusive jurisdiction, subject to mandatory consumer protections that may apply to you in your country of residence.

15. General

  • Entire agreement: These Terms, the DPA, and the Privacy Policy are the entire agreement regarding the Services and supersede prior understandings on the same subject.
  • Severability: If any provision is unenforceable, the remainder stays in effect.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Assignment: You may not assign these Terms without our consent. We may assign to an affiliate or in connection with a merger or sale.
